Hi Gurus,
I am in a interesting situation. I have an approved EB2 I-140 but I recently applied for EB1-140 and I-485 concurrently and they are pending. Given that all PDs are now current, is it possible to convert my I-485 to the approved EB2 I-140. This will remove the uncertainty around approval of EB1 I-140. Any advice/experience is appreciated.

What if, only H4 holder (AOS pending) returns to USA using valid (till Dec' 09) H4 stamping ? Do they (at POE) come to know that spouse's 485 has been approved ?
H1 holder (485 approved) will return afer couple of days.

Hi all,
I submitted an application via premium processing for EB-1a with USCIS at the Texas Premium Processing Centre last month (April 2007).
I received an RFE notification via letter after two weeks listing the requirement of further evidence against 3 out of the 8 criteria I submitted.
I can submit further evidence - but my question is this ... "Why have they not made mention of the other 5 criteria I submitted" ? Has this failed ? Do they not matter ?. I am quite concerned because they have not made any mention of my other criteria ? Does anyone have any advice.

There is a complete black box on the other side and you should be prepared for all 8 in case a query comes. good luck!

No question is new on IV. Every question has already been answered multiple times, by several people and in great detail. Use the search feature and avoid redundancy. For example,

Hi Everyone,

1. I'm on F1 and got pregnant. Can i take a break for sometime and get back to studies?
2. My husband is a GC holder..well we got married after he got GC ( i know what you guys must be thinking :-))...now can he apply for a family based GC for me, i kind of know that it takes atleast 4 yrs for me to get GC...but just wanted to make sure that he can apply while i'm on F1...pls share your views...

Yes if she has worked after admission in the US - Qualifies for this
No if she is going to be dependent on my H1B - Qualifies from the date of approval
What should be choice in this case as she will have worked for 10 months before getting the H4
We also need to provide employment details on part 4 continued section for both Yes and NO
can somebody throw some light on this?

Hi,
In anticipation of birth certificate RFE, i have BC affidavits (from parents and relatives) and NAC ready to submit it will be requested. However, my priority date is not current and god knows, when it will be current.....My question is: Is there a validity period for these BC affidavits and NAC documents? It is almost one year since these documents are made ready and I was wondering if these documents lose their validity one year after the signed date on them?

I don't think there is a validity period for affidavits. But just make sure your parents affidavit is attested by a notary. I had a problem with the original birth certificate and I submitted a notarized statement from parents as an addendum when filing my 485 in June 2007. I had the notarized affidavit from early 2006. It was apparently sufficient.

There are really 2 sub-categories of EB-3. One requires a minimum of a bachelor's degree, or equivalent in education/experience. The other requires just 2 years skilled worker experience.
The question is what your position really is, and what the employer requires. If the position really requires you to speak Korean, it can get approved. However, adding a foreign language requirement definitely invites intense scrutiny, and it can really only work if you can show that you spend a lot of your time using Korean and the company could not manage without it. You also need to show that you use Korean with people who cannot speak English, not just that they don't want to speak English. You need extensive back-up documents to prove the foreign language requirement.

Me and my wife filed H1B extension through a company. I moved to consulting after my extension is approved. The consulting company filed my H1B transfer which is approved recently. Unfortunately my employer (the consulting company I moved to) dint file for my wife's H4 extension and he told that was not needed.

My wife has H4 stamped and valid till Nov 2008 but from Oct 2007 she changed her status to H1B. She has I797. My question is when she goes to India does she need to stamp H1 B or she can reenter on already stamped H4 ?

My H1b Visa expired in 05/2010 and I just got my 3-year extention.
In my petition I gave details of current client.
Today an Agent came from USCIS for an onsite(client-side) visit and verification.
The agent asked me various question mostly related to my petition
I was told my name was picked up randomly.

As a home buyer or even as an owner you should be aware of this. But I am a bit puzzled by this story. Usually the title insurance that you get at the time of buying home is supposed to cover any such issues. In this case may be they did not get title insurance or their title insurance didn't cover enough amount.
Also as a home owner, if you get some work/improvements done at your home by a contractor make sure you get a signed declaration from him every time you pay him. The declaration should say that he has paid all his workers their dues and that he will be responsible for any payment disputes arising later if any.
