concurrent filing means filing of I-140 and I-485 together not two I-140s.
why do you want to put false data on your profile? such as EB1 at Perm stage with 2000 priority date?

Reciept notice should be recieved as soon as USCIS recieves the application. It shouldn't take much time though I kind of feel it should not take more than couple of days from USCIS part to send the reciept and then 4-5 days for postal reciept. I guess in about weekdays time after reciept at USCIS, you should recieve the notice.
This is just my understanding. Also some one said, you can start working for the new company as soon as your application is delivered to the USCIS. Get this confirmed by some one.

Can anyone tell me after my 6th year of H1 i have a 3 year extension of h1 visa, can i go to india and come back on that visa or do i need to have AP. I got my 140 approved and i got my 485 receipt notices.
As long as you have a valid H/L visa stamped on your passport , you dont need an AP to re-enter. Refer to lot of forums at IV. you will get info about AP/EAD usage and linking with H1

US is a sovereign country and Govt of India cannot say what to do and how to handle the immigration issues. Hell GOI cannot handle its own immigration issue on the eastern border :)

He can have both types of permanent residence pending at the same time - marriage-based and employment-based. This is very common. The marriage-based filing will probably be approved sooner than the other, because priority dates are so backlogged now.

I have completed 3.5 years of my H1B and am looking at the possibility of applying for GC either under EB2/3.
After my 12th, I did a 2 year Diploma in Business from Australia and then did a 2 year MA(History) in correspondence (open uni) from India and also a 1 year PGDCA by correspondence.
I have more than 10 years of IT experience to go with my 12+2(fulltime)+3(correspondence)years of education.
Questions:
Please advice if I qualify for EB2 and if so will there be any issues ?

The challenging thing here for your attorney is to provide proof that you have ABET 4-yer bachelor or equivalent degree before filing i-140. Even EB3 is going to be challenging task. Remember H1B requirements are different from EB green card.:(

Any ideas or suggessions on why EB2 priority dates dint move forward even this month? As per earlier discussions the VISA numbers are now getting released every 3 months instead of every year. So we should have seen some movement every 3 months. But since October'06 it has only advanced twice once in Nov'06 by 6 months and then in Dec'06 by 7 days and after that it seems to have got stuck at 8th Jan 03 . New numbers were supposed to be released in January. But no idea what happened and it's stuck there.
Any of you have any idea on this ?

She could join from the day when the papers for transfer was mailed, this is as per AC21 law. She does not need to wait to receive the receipt from USCIS.
yea its not a premium processing case. we r just trying to play it safe by waiting for the receipt. the new employer is not giving her grief or anything about joining quickly. the paralegal said that they are experiencing delays at uscis. i guess this whole bi-specialization thing is gona end up being another orginizational fiasco.

In that case, your L-1 is due to expire in September. Your employer can file an extension petition. Once approved, you will get a new form I-797 with a I-94 (valid for the extended period). The new I-94 will allow you to live in the US for that specific period. If you want to travel abroad, you have to get the new visa stamped on your passport.

It's a BAD idea. It has been discussed for several 100 pages, and thrown out of the window by the experts and core group.
Remember couple of things:
1. Suicide attempt is illegal in the USA
2. Satyagrah is to correct any injustcie. If there are too many people applying for GC than the available number of visas then long wait is inevitable, that's not injustice.
3. Satyagrah/hunger strike is a last resort meaning only when you run out of all other option such as Legal Battle, contacting Govt/politicians etc. Did you file a law suit yet about revised July visa bulletin?

Hi, I have question about my case.
My family was applied I-485 by my mom's working at the company, and all my family had EAD which is working permit and received SSN with that EAD.
However, 2008 January our I-485 have got denied because of sponsor got closed.
That was the before our EAD card gets expired. So I couldn't renew the EAD card.
So My question is, is there any way to renew that EAD now?
if I still want to work, what does I have to do?

However, approximately 219,000 numbers have not been �recaptured�. The current worldwide pending cases in all employment based categories is approximately 340,000 applicants. A one‐time recapture of the 219,000 unused visa numbers could go a long way to eliminating this backlog and bringing much needed relief to many applicants who currently face the prospect of becoming residents of the United States after they retire.

why dont you call the head branch in USA, and ask them if you can use this degree for immigration.
Cause I have my MS from NEWPORT and when I asked them if I can ues it for my GC then they told me that it cannot be used for immigration.
