I have read somewhere that e-filed 140s are processed by TSC [which is a good thing for me because I have heard that TSC is lenient with cases like mine - 3 year degree ]

Hi Guys,
As i said earlier my I-140 was denied for the reason below
I have US masters and 4+years of US job experience and My I-140 was filed in EB2 using a Substitution labor which as the education/experience requirements of (14) Masters+1years experience or (15) Bachelors + 3Years Experience and it was denied without RFE saying the Labor certification used is not suitable for EB2 as they say EB2 labor should be requiring "Masters or BS+5Years Exp", which makes sense.
My Attorney filed an MTR (I290B) on 03/11/2008 and requested the USCIS NSC center to re-consider my case as EB-3 instead as EB2.
Today 03/21/08 i just got an update from USCIS saying:
Current Status: Appeal/Motion/Certification sent to Administrative Appeals Office for review.
On March 21, 2008, we sent this case to the Administrative Appeals Office for review. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, call customer service.
1- So now what are the chances of my I-140 getting approved and how many days does the AAO take to make any decision on this?
2- And for my 485/EAD/AP/FP i did not get any message saying that they are denied and my wife is still working on her EAD on advice of the attorney and as the I-140 is with AAO can she still continue the same job until the decision is made on the I-140 and 485.
Please help me out and advice on what should i be doing at this point and what are my options on this.

My LCA for H1B extn for 6 years is approved on July 15. But still my company lawyer is not ready to file the extn. He keeps on saying that I didn't get the approval notice from DOL, It's certified online only, So without physical approval document, I cannot proceed.
Guys, Since it's certified already, Can he get a LCA detail and print using his account from iCert?
I also checked the online status in iCert (he gave me the case No), the status says certified.
So in this How long DOL took to send the physical copy of LCA?
Since my H1B is expiring October, I need to file extn ASAP. My company lawyer is not helpful ...

H1B, Perm/I140 are all employer driven. You are a mere spectator in this whole process.

Hi gurus,
I have been working with employer A since last 3 years. My I-140 (EB3)has been filed on April 1, 2008 and my priority date is January 9, 2008. I am planning on changing jobs within the same company but in a different state / city.
1)Would this affect my I-140 processing
2) Would this create any issues in the future stages of the green card process
3)Will I still be able to keep the same priority date for the I-485 (God knows when I'll get to that stage...)

You have some good pictures, but I agree you would more easily get responses here if you include pictures in your post. One critique I can give is you should watch the level of your horizons, it's a pet pieve of mine as some here know :), I'm sensitive to leaning pictures.

HI my wife is from Mumbai... now we have already passed the appointments dates in Aug for Mumbai.. but some are availabke in Delhi.. is it possible to apply in Delhi even if u r from Mumbai... Has any1 done tht before?

Hi,
I was working on L1 before and my h1 was approved in october but i joined on h1 only in december before the 60 day grace period?
Now i need to visit to india so
1) Will there be any problem to get stamped in india if i travel in April ?
2) Can i get stamped in Mexico or Canada? How many pay slips n other documents do i need ? What is the process of getting stamped in Mexico or Canada?
3) Which one is less risky (going to mexico or canada) ?
Please let me know ASAP. I appreciate your help on this.

2. ..................Normally they ask for recent paystubs, but if it is within last 1-2 months it sails through well, w/o triggering RFE. Best option is to do H1b Tranfer under premium processing mode, that way in just few weeks you would know where you stand.
3. ........................ either F1 or H4 or Visitor visa.

After a week full of outrage about the Arizona Immigration law, we are happy to report about an opposite spirit coming all the way from the state of New York.
Gov. David Paterson stepped into the immigration debate Monday, saying he would create the nation's first "pardon panel" to investigate requests of legal immigrants facing deportation because of past convictions.
Paterson, proposing the measure as the nation is embroiled in conflict over an Arizona law that critics say would encourage racial profiling, said he would pardon immigrants if they meet requirements including rehabilitation and demonstrate they're not a danger to society.
Paterson is seeking to combat what he calls harsh and rigid federal measures that result in deporting of immigrants who have shown considerable rehabilitation. Arizona's measure makes it a crime under state law to be in the country illegally.
Paterson said he will seek to use a governor's pardon as a tool to blunt what he called the rigid federal rules for deportation even of immigrants who have successfully engaged in a new life in America. In March, Paterson pardoned Quing Wu, an executive and Chinese immigrant who as a teenager was convicted of a smuggling.
We hope more states will follow this trend, and focus on the real effort - Immigration reform now.

If the I-94 was not given a full year's validity due to passport expiring within a year, Is the I-94 still valid after its expiry?
As far as I-94 goes it will expire but since you are already in AOS status, it really does't matter.

I-140 approved. I haven't applied for I-140 yet.
I am looking to move to different position with similar job responsibilities within my company.
I spoke to company's internal legal dept - and as per them they would require -
a) My current job responsibilty as filed on GC app
b) New Job responsibilties from new manager
c) A note from new manager stating that new job responsibilities are similar to current one.
With this documentation, I could use my existing I-140 & don't have to file for H1-B, labor & I-140 again.
Do I need to be concerned for anything else?
